In most likely scenario this was another nail driven into the coffin of the company that will soon go belly up. Vonage made a statement earlier stating that while the court decides their fate, the company is working on finding alternative technology that doesnt infringe on Verizon patents. “We’re continuing to evaluate and develop workarounds for the technologies the jury found we’re infringing upon” says Brooke Schulz, Vonages vice president of communications. Many journalists who closely follow patent dispute between Verizon Communications and Vonage Holdings claim that Vonage infringed on key Verizon patents that deal with Internet calling, including technology used to connect Web calls to ordinary phone lines. In this brief article I will try to take a closer look at three patents that are at the heart of this dispute, comment on them and let readers decide how key they really are. Commenting on first two Patents One thing for sure - it will be extremely difficult for Vonage Holdings to find any alternative technologies that doesnt infringe on Verizon patents simply because they cover almost all aspects of VoIP communications. The jury found Vonage guilty in violating three of Verizon patents. Two of these patents (6,104,711 and 6,282,574) are very similar and deal with the concept of translating phone numbers into IP addresses and improving DNS Services. The thing is these patents never ever mention an algorithm or a pseudo-code on how to solve the problem at hand. Verizon structured these patents in such a way that they are extremely broad in scope and highly generic. Commenting on the third Patent The last patent (numbered 6,359,880) is titled Public wireless/cordless internet gateway” and it describes various business processes that involve in sending and receiving all types of VoIP signals over wireless networks. Once again this patent does not contain any algorithms, data structures, pseudo-code or electrical diagrams; just generalized concepts and ideas. Conclusion As one can see, Verizon fight against Vonage was less about inappropriate use of strategic scientific information (or key ideas), but was designed to be a way to strangle the competition. Vonage was able to offer their phone services quicker and more cheaply then its bigger rival and this sealed its fate. I would hate to be in the shoes of Vonage founders who realize that they may lose the company they have built from the ground up on the grounds of legal technicalities. Many agree that Verizon patents are too broad and generic; however, U.S. District Court have interpreted them differently and it spells the end for Vonage. The lesson that one should learn from the above mentioned litigation is that one should start thinking about getting a Patent very early. Law enforcement officers have been trained to identify driving patterns that indicate a probability that a motorcyclist is driving while intoxicated. The driving patterns that police typically look for have been outlined by the National Highway Traffic and Safety Administration (NHTSA). NHTSA has delineated a number of cues that police officers can look for in detecting intoxicated motorcyclists. The list presented below represents, in descending order, the visual cues giving rise to the probability that the motorcyclist observed is driving while intoxicated. Often, police officers will observe several cues in conjunction, which increases the probability that the driver is intoxicated, that is, driving with a blood alcohol content (BAC), over the legal limit. Studies have indicated that cues by themselves or in conjunction with other cues, give rise to a statistical probability of intoxication. The following cues have shown a 50% or greater probability in predicting impaired motorcycle operation. However, it is also 50% as likely that these cues do not reflect intoxication. Drifting During Turn or Curve Drifting during a turn or curve is the most common cause of single vehicle, motorcycle crashes. This occurs when the motorcycle and rider continues in a straight line instead of turning with the road, ultimately resulting in hitting a stationary object. Another way this cue represents itself is where the motorcycle appears to drift to the outside of the lane, or into another lane, through the curve or while turning a corner. However, drifting in a lane is not uncommon where a person is distracted or is unfamiliar with the landscape. Trouble with Dismount Law enforcement officers look at the dismount as a helpful field sobriety test, as it is reflective of coordination and judgment. First, the motorcyclist must decide upon a safe place to stop the bike. Then the motorcyclist must turn off the engine, locate and deploy the kickstand, then balance on one foot while swinging the other foot over the seat to dismount. Officers look for any problems in the preceding sequence as evidence of alcohol impairment. However, trouble with dismount is not necessarily an indication of intoxication. Where the officer pulls over the motorcyclist has a lot to do with the location of dismount. Plus, most people are rather nervous when pulled over, which is distracting. These factors have a lot to do with a dismount that takes place in front of an officer while he is waiting to write you a ticket. Trouble with Balance at Stop There are two general methods of balancing at a complete stop. One, where the rider places one foot on the ground to keep the bike upright, while leaving the other foot on the peg nearest the gear shift lever. Two, where the rider places both feet on the ground for stability. Law enforcement officers look for a shifting from side to side, in a rocking motion, in an effort to maintain balance at a stop. However, there may be several reasons a rider cannot maintain balance, for example, if the road is not even, the bike is unfamiliar, or the rider is of small stature Turning Problems 1) Unsteady During Turn or Curve: Law enforcement officers look for a motorcycles wheels to wobble when making a turn. However, when the motorcycle is undergoing a turn or curve, it must slow down, which makes it less stable in an upright position. At higher speeds the gyroscopic effects of a motorcycles wheels tend to keep the motorcycle on track so long as the speed is maintained. At slower speeds, the motorcycle is unsteady, so there is a higher probability of wobbling while turning. 2) Late Breaking During a Turn: Law enforcement officers look for the application of break lights during the turn as opposed to prior to the turn, as indicating impairment due to intoxication. The rationale here is that a motorcyclist normally breaks prior to entering a turn or curve, so the motorcycle can accelerate through the maneuver for maximum control. However, there are many reasons a rider would break during a turn as opposed to prior. For example, the rider may just drive that way, or is unfamiliar with the streets and the street he needs to turn on comes up faster than expected, or any number of reasons, which are not alcohol-related. 3) Improper Lean During Turn: Law enforcement officers look for the rider to be in an upright position during a turn, instead of leaning into the curve. However, NHTSA indicates that this cue is observable by a trained observer, meaning it is not apparent otherwise. Also, where the turn is made safely, there is no indication of impairment due to intoxication. 4) Erratic Movements During Turn: Law enforcement officers look for any sudden correction of a motorcycle during a turn or curve. However, there are many other factors which would cause a sudden movement during a turn. For example, the condition of the road may necessitate such a maneuver. Inattentive to Surroundings Law enforcement officers look for such things as: 1) Failing to notice the light has changed. However, people do this everyday, being lost in thought for example, is a primary reason and is not an indication of intoxication. 2) Failing to scan the area around the bike in traffic. However, this is not a requirement required by the DMV and is not necessary where the driver is experienced and the traffic is light. The motorcyclist decides based on road factors, traffic flow, and surroundings how vigilant to be; it is subjective and not an indication of intoxication. 3) Failing to respond to officers emergency lights or hand signals. However, this cue can be negated by many reasonable factors, like the motorcyclist concentrating on the road, waiting to pull over on a safer stretch of road, or simply not observing the hand signals. Inappropriate or Unusual Behavior Officers are looking for any sorts of behavior which are unusual or inappropriate. However, this is a matter of subjection and is not necessarily an indicator of intoxication, but matters of circumstance. Weaving Weaving includes weaving within a lane and weaving across lane lines. However, weaving may occur to avoid road hazards. The following cues have been shown to have a 30-50% probability of indicating intoxication. However, at the same time, they are 50-70% times as likely of not being an indicator of intoxication. Erratic Movements While Going StraightLaw enforcement officers look for any sudden corrections while attempting to ride in a straight line. However, the NHTSA studied reflected a 51-70% probability that there is no impairment reflected in this cue. Operating without Lights at Night Because of the danger involved in motorcycles driving without lights at night, the NHTSA studies indicated that there is a good chance that the operator is intoxicated. However, there is a higher likelihood that this cue is not due to intoxication, but rather just an oversight of the rider. RecklessnessOfficers look for riding too fast as an indicator of impairment. However, motorcyclists tend to ride faster than autos, so speeding is not necessarily an indicator of impairment. Following too Closely Officers look for a rider following at an unsafe following distance. However, the distance between the motorcycle and other cars is not totally within the motorcyclists control. Cars slowing would naturally decrease the following distance. Running Stop Light or Sign Officers look for the motorcycle failing to stop at a light or sign. However, cars and motorcycle riders run lights and signs all the time, for a variety of reasons which are not indicators of intoxication. Evasion This cue occurs when an officer attempts to pull the motorcycle over and the motorcycle rider attempts to flee the officer instead. This is a common occurrence which has nothing to do with impairment, 50-70% of the time. Wrong Way This cue occurs when the motorcycle is riding into opposing traffic, such as going the wrong way on a one-way street or crossing a center divider line to ride into opposing traffic. However, 50-70% of the time this cue is not an indicator of impairment. Going the wrong way on a one-way street occurs with drivers everyday and is usually a matter of mistake. Crossing the divider line also occurs as a sudden movement to avoid another car going into the lane which occurs frequently to motorcycles because other drivers do not pay attention to the presence of motorcycles. Researchers also used such tips as having them lay down their spoons between bites, and chew their food thoroughly, between 15 and 20 times. This chewing thing is interesting, because I had heard about a “chewing diet” in which participants were to chew their food several times before swallowing. It all sounded a little mystical to me, and I was inclined to write it off until I read more about research at the University of Rhode Island. It seems that when the diner chews the food 15-20 times, several things happen. Apparently, the trigger is that thorough chewing helps to release about 50% more nutrients in the first minute after the food enters the stomach. As a result, blood flow to the digestive organs is raised nearly instantly raising the metabolism. This, in turn, results in a more rapid onset of a feeling of fullness, causing the diner to feel full…and finished…sooner, thus preventing the ingestion of excess calories. It has long been known that one problem with weight loss is that we simply tend to eat more food than we really need or want. Part of this is the result of the fact that signals of fullness take their own sweet time getting through to the brain, allowing us to take in more food than was really required or desired. So, slow down. Chew your food carefully. Enjoy the taste and flavor of each morsel. Maybe even take smaller bites. The researchers also found that giving the participants smaller spoons helped. Lists of diet tips have long included the admonition to serve meals on smaller plates as that helped the portions appear bigger and more psychologically satisfying. By Cyndi Roberts Yard sales (or garage sales as we call them in my part of Texas)are a wonderful frugal source for almost anything you need.They can also be a wonderful, frugal source of extra moneyalmost any time you need it. When shopping at yard sales, it’s important to remember thatmost things you buy are not going to be in “new” condition, althoughthere are times when you will find items that are brand new, inthe box. And at a much lower price than in the store. Most yard sales have lots of clothes for sale. But if you arewilling to take a closer look, you may find tons of treasures.The other day I found a shiny cookie sheet in a box of “freebies”!I was thrilled and so was my son, who didn’t have one! My grandchildren have tons of books, most of which have beenbought at yard sales. And all were in great condition and didn’tcost over 50 cents apiece. I keep a lookout for seasonal itemsfor kids such as coloring books, little stuffed animals, etc. Thenwhen Valentine’s, Halloween or other holidays roll around, wesend the grandchildren a package filled with neat stuff for verylittle cash. This summer I am also watching for “new-in-the-box” toys forchildren of all ages. In December, I’m going to send them withmy son (who is in the Texas National Guard) to their annualToy Drive. But almost every community has some sort of toydrive at Christmas time. This way, I will already have my contributionsand won’t need to go out and spend more money during the holidayseason. Yard sales are a great way to make some extra money, also. Plus,you can get rid of unwanted items at the same time. My daughterand I recently held a sale and here are some of the things welearned. Put up signs. The newspaper goofed the weekend of our sale and leftout all that week’s yard sales. So we had to depend on our signs.Put as many out as you can. Find out ahead of time what kind ofordinances your town has about placement. Take the time to make your signs…we bought ours and abouthalfway through the first morning, we noticed that we weren’t gettingany customers. So we checked out our signs–and they were gone!We put out more and the customers started coming again. But itwas costly. And when you make your signs, be sure to make them sturdy enough to stand up in the wind and also be sure your lettering is large enoughto be seen by people driving by in cars. I think a large arrow pointingin the direction they need to go is helpful. Be sure to plainly mark your items. It will save you lots of timeduring the sale if you don’t have to talk to each customer about theprice of every item. If you aren’t sure what prices to ask, it might help to go out to some yard salesyourself in the weeks before your sale and check out what others are asking for items. If you really want to get rid of something, be willing to negotiate on theprice. By the same token, if you really want to get a certain amount,be willing to say no when someone asks for a price reduction. When your yard sale is over, if you are lucky, you have space to store theleftovers until next time you need to hold a sale. By Shannon Miller Some families have budgets and some do not. Those families with budgets can better manage their money than those who do not. I would recommend any family with children to have a budget. Here are a few steps for planning a budget. 1. Get a list of all your bills that are due each month. Also get the dates that each bill is due on. It is always best to plan your budget by the month. 2. Organize those bills by the date that they are due on. Ex. Electric bill due on the 2nd, the phone bill due on the 7th, and the cable bill due on the 17th. And so on. 3. See how many pay days are in the month that you are planning for. Then figure how much money you will make on each pay day and times it by the number of pay days. Ex. 4 pay days times $500.00 per pay day equals $2000.00 4. Figure up how much your bills are all together. Divide that by the number of pay days that you have for that month. This will give you an idea of what you are going to have to pay each week. If there is going to be a week where you wont have to pay put that much take it out anyway and put it into your savings. That way if something comes up and I promise you one time or another something unexpected will come up. If you put money back when you have it extra you can be prepared for those unexpected moments without having to charge your credit cards. 5. Write down each pay day and the bills that you will be paying on that particular day. That way you will know exactly what will need to be paid and when. Place it where ever you pay your bills. Or if you dont have a specific place you do your bills place it on the refrigerator. 6. Stick to your budget no matter what. Do not stray from your budget. Each pay day have those bills made out and ready to send off. I know that it can be easy to think I will just pay this one next week, but once you get behind it is too hard to catch back up. So by all means stick to your budget. If you have a budget that works for you and your family you will have more money left over each month to do something special with your family. My family makes it a point to do something special each month as a family. If we did not have a budget we would not be able to do that special something together.
